These terms apply to all in-person and virtual services provided by FiveTwenty Studio. By authorizing work, approving a project, or paying an invoice, the client agrees to the following terms.
The project scope, design rate, deliverables, service format, and payment schedule will be communicated before work begins.
Services are billed at the agreed hourly rate. Additional work, revisions, meetings, site visits, or deliverables outside the approved scope will be billed separately with the client’s prior approval.
Invoices must be paid by the stated due date. FiveTwenty Studio may pause services and withhold final deliverables while any balance remains unpaid.
Services may be provided in person, virtually, or through a combination of both, depending on the project and location.
For virtual services: The client is responsible for providing accurate measurements, photographs, videos, floor plans, existing furniture dimensions, property information, and other details required to complete the design remotely.
FiveTwenty Studio will rely on the information provided by the client and will not be responsible for errors, unsuitable selections, additional costs, or installation issues resulting from inaccurate, incomplete, or outdated information.
For in-person services: The client must provide safe and timely access to the property. Site visits are conducted for design observation and information gathering only and do not constitute a technical inspection, property survey, code inspection, or verification of concealed conditions.
Travel, parking, accommodations, or other site-related expenses may be billed separately when disclosed and approved before the visit.
All measurements, quantities, clearances, site conditions, access requirements, and product compatibility must be independently verified before purchasing, fabrication, construction, delivery, or installation.
For virtual projects, all client-provided measurements must be verified on-site by the client, contractor, installer, vendor, or another qualified professional.
FiveTwenty Studio is not responsible for products that do not fit or for additional costs arising from incorrect measurements, unverified dimensions, building access restrictions, or undisclosed site conditions.
Plans, renderings, mood boards, elevations, product selections, specifications, and other materials communicate the intended design direction and are provided for design guidance.
Unless expressly included under a separate written agreement, deliverables are not engineering documents, permit drawings, stamped construction documents, technical surveys, or substitutes for review by appropriately licensed local professionals.
The client is responsible for confirming compliance with building requirements, property restrictions, safety standards, lease conditions, and applicable regulations before implementation.
Renderings are visual representations only. Actual colors, lighting, textures, scale, finishes, and products may appear different in person.
Included revisions will be identified in the approved project scope.
Changes to an approved direction, budget, requirements, previously supplied information, or project scope may require additional billable hours.
Additional work will be discussed with the client before proceeding.
Product prices, availability, dimensions, colors, finishes, lead times, and vendor policies may change without notice.
Unless purchasing or procurement is expressly included, the client is responsible for placing orders, verifying product details, processing payments, coordinating deliveries, and managing returns, exchanges, damages, warranties, and claims.
FiveTwenty Studio is not responsible for discontinued products, vendor errors, shipping delays, defects, delivery damage, installation problems, contractor performance, or differences between digital images, samples, and finished products.
Vendors, contractors, installers, delivery companies, and other service providers are independent third parties. The client is responsible for reviewing and approving all third-party quotations, contracts, purchases, and services.
The client retains final decision-making authority over all designs, products, materials, contractors, purchases, and implementation.
Approval provided through email, digital message, online form, PayPal, video meeting follow-up, or another written channel will be considered authorization to proceed.
The client assumes responsibility for the final use and implementation of all approved recommendations.
The client may cancel the project by providing written notice.
Fees covering services already performed are non-refundable. FiveTwenty Studio may suspend or terminate services due to nonpayment, prolonged inactivity, incomplete information, unsafe site conditions, abusive conduct, or failure to cooperate with the design process.
All concepts, drawings, renderings, presentations, selections, and design materials remain the intellectual property of FiveTwenty Studio.
After full payment, the client receives permission to use the final deliverables solely for the property and project for which they were prepared.
Design materials may not be copied, resold, transferred to another project, commercially distributed, or represented as another person’s work without written permission.
Services and recommendations are provided in good faith based on professional judgment and the information available at the time.
FiveTwenty Studio makes no guarantee or warranty regarding product performance, availability, construction results, contractor workmanship, project completion dates, property value, or the final outcome of implementation.
To the fullest extent permitted by applicable law, FiveTwenty Studio will not be liable for any injury, property damage, purchasing expense, installation issue, construction issue, delay, loss of use, lost profit, or indirect, incidental, special, punitive, or consequential damages arising from the project.
This limitation includes claims involving design implementation, client-provided information, measurements, products, vendors, contractors, installers, deliveries, construction, and other third-party services.
For virtual services, the client expressly accepts the risks associated with remote design and assumes responsibility for the accuracy of all site information, measurements, photographs, videos, and property conditions supplied to FiveTwenty Studio.
If FiveTwenty Studio is found liable for any claim, its total cumulative liability will not exceed the design fees actually paid by the client for the specific service giving rise to the claim.
By authorizing work, approving a design direction, or paying an invoice, the client confirms that they have read, understood, and accepted these Terms and Conditions.
